TERMS OF SITE

General

These Terms of Site apply to the Ladbrokes.com, Ladbrokescasino.com, Ladbrokespoker.com, Ladbrokesbingo.com and Ladbrokesgames.com websites and all Ladbrokes software and games ("Products").

Ladbrokes General Rules also apply to certain Products and in the event of any inconsistency between these Terms of Site and the General Rules, the General Rules will prevail. Specific rules may also apply to certain games or particular bets.

These Terms of Site, the General Rules and any specific games rules or specific betting rules are collectively called "Ladbrokes' Rules".

In these Terms of Site, "we/us/our" refers to Ladbrokes Betting and Gaming Limited and/or its group or associated companies.


1.INTELLECTUAL PROPERTY

1.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied or made available to you as part of the Products shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

1.2 You acknowledge and agree that the material and content contained within the Ladbrokes.com, Ladbrokescasino.com, Ladbrokespoker.com, Ladbrokesbingo.com and Ladbrokesgames.com websites and/or otherwise provided as part of the Products is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of such material and content is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit, tamper with or create derivative works of such material and content.


2. COMPLIANCE WITH LAWS

The Products may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Products and any bets placed on or via the Products.


3. NO WARRANTY

3.1 We will endeavour to provide the Products using our reasonable skill and care. We make no further warranty or representation, whether express or implied, in relation to the Products. All implied warranties or conditions of satisfactory quality, fitness for purpose, completeness or accuracy are hereby excluded.

3.2 We make no warranty that the Products will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Ladbrokes.com, Ladbrokescasino.com, Ladbrokespoker.com, Ladbrokesbingo.com and Ladbrokesgames.com websites or the server that makes them available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials or as to results or the accuracy of any information obtained by you through the Products.

3.3 In the event of systems or communications errors relating to the generation of random numbers, bet settlement, race result or other element of the Products, we will not be liable to you as a result of any such errors and we reserve the right to void all bets on the draws or races (as applicable) in question.


4. LIMITATION OF LIABILITY

4.1 You agree that your use of the Products is at your sole risk.

4.2 We shall not be liable in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with your use of the Products, whether direct or indirect, including, without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary or consequential loss (even where we have been notified by you of the possibility of such loss or damage).

4.3 We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Products and you confirm that we shall not be liable to you or any third party for any modification to, suspension of or discontinuance of the Products.

4.4 Nothing in these Terms of Site, any of the Ladbrokes Rules shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.


5. INDEMNITY

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of any breach by you of any of the Ladbrokes Rules or otherwise arising out of your use of the Products or any use by any other person accessing the Products using your user identification.


6. TERMINATION

6.1 We may terminate your account (including your username and password) if we believe that you have breached any of the Ladbrokes Rules or have acted in a manner inconsistent with the spirit of any of them or for any reason we discontinue to provide the Products.

6.2 You acknowledge that we do not have to give you prior notice of any such termination.


7. GENERAL

7.1 No bet can be cancelled by a customer once confirmed by us. All bets stand once confirmed whether the customer is on-line or off-line, subject to the provisions set out in clause 3.3.

7.2 We reserve the right to withdraw the Products or elements of the Products at any time, and will not be liable to you as a result of any such action.

7.3 If any part of the Ladbrokes Rules shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Ladbrokes Rules and shall not effect the validity and enforceability of any of the remaining provisions of the Ladbrokes Rules.

7.4 No waiver by us of any of the Ladbrokes Rules shall be construed as a waiver of any preceding or succeeding breach of any of the Ladbrokes Rules.

7.5 Unless otherwise expressly stated, nothing in the Ladbrokes Rules shall create or confer any rights or any other benefits whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise in favour of any person other than you and us.

7.6 Nothing in the Ladbrokes Rules shall be construed as creating any agency, partnership or any other form of joint enterprise between you and us.

7.7 The Ladbrokes Rules contain the entire agreement between you and us relating to the Products. You confirm that, in agreeing to the Ladbrokes Rules, you have not relied on any representation save insofar as the same has expressly been made a representation in the Ladbrokes Rules. You agree that you shall have no remedy in respect of any misrepresentation which has not become a term of the Ladbrokes Rules save that your agreement shall not apply in respect of any fraudulent or negligent misrepresentation whether or not such term has become a term of the Ladbrokes Rules.

7.8 We reserve the right to publish and promote details of Product winners. The winning cash amounts published will include player stakes.


8. LAW

8.1 The Ladbrokes Rules shall be governed by the law of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.


Your Use of the site

1. ACCEPTANCE AND VALIDATION OF BETS

In order for a bet to be valid, you must receive a bet number confirming from us that your bet has been accepted. This will be via a confirmation message that will appear on your screen.

We reserve the right to accept or decline all, or part of any bet requested.

We do not accept bets received by post, email or any other form of data transmission. Details of how to open a telephone betting account are contained in the "About Us" section.

Where we believe that price or match-rigging has taken place, either as a result of the size or volume of bets received, or from other evidence, or where the integrity of an individual event is called into question, we reserve the right to withhold payment and ultimately to declare bets on that event void.

Any bet accepted, in error, for an event that has already taken place, or where betting has been suspended, will be void, win or lose.

Every effort will be made to ensure that all information available on the Ladbrokes websites is accurate. However, if an error is made in the prices or conditions published on-line, we reserve the right to correct any mistakes and to settle any bets already laid at the correct price.

We reserve the right to close a customer's account, with notice, without affecting any outstanding bets.

Once accepted by us, bets cannot be cancelled or amended in any way by the customer.


2. MAXIMUM PAYOUT

The maximum payout to any one customer on any one day, including Ante-Post, is �£250,000 unless stated otherwise in the rules of any particular game, bet or Product. Please bear maximum payout amounts in mind when you place your bet. Even if by taking prices our limits are exceeded, the maximum payout will still apply. The amounts stated refer to the total returns on your bet including original stake.

The exceptions to this rule are for bets on the Cheltenham Festival and the 'Ladbrokes Millionaire'. On both of these it is possible to win a maximum payout of �£1million on one day.

All maximums stated within these rules apply to any one customer, or group of customers acting together, backing the same combination of selections even if it is done in a series of bets, at a range of prices, over a number of days via any Ladbrokes Internet betting accounts.

Should we have reason to believe that a number of bets have been placed in this way, the total payment of all those bets combined will be limited to one single maximum payout.


3. OPENING AND MAINTAINING YOUR ACCOUNT

You must be over 18 years of age to register and to place a bet. We reserve the right to ask for proof of age from any customer and customer accounts may be suspended until satisfactory proof of age is provided.

Opening of accounts, bet processing or financial transactions will not be accepted from individuals residing in USA, its territories or possessions. We also reserve the right to request proof of residence from persons who wish to use USA-issued credit cards to pay for transactions. It is the responsibility of each individual customer to ensure that they comply completely with their own local, national or state laws concerning betting, prior to them registering, or before placing a bet.

Customers are asked to ensure that the details provided at registration (for example address, telephone number, email etc.) are kept up to date. You can access and amend your own individual account information by clicking on "Personal Details" in the "Your Account" area of the site.

When opening an account with each customer is requested to choose his or her own user name and password. Customers are asked to ensure that these details are kept private, as customers are responsible for all bets accepted on their account, where the correct security information has been provided, dependent only on the current balance of the account. If you lose, or forget your username and/or password, or if you are concerned that a third party is aware of them, you should contact our Customer Service team immediately in order that new security details can be allocated to you. These new details will be emailed to you by our Customer Service team.

The minimum account deposit is �£5 or equivalent, and you can only bet up to the amount available within your account. Interest is not paid on monies held in a customer account.

By registering, a customer is deemed to have fully accepted and understood all the Ladbrokes Rules.


4. PAYMENT OF WINNINGS

Returns due on bets placed online will be added to your current deposit balance once the bet has been settled. This balance will remain in your Internet account unless you submit an online request part, or all of the outstanding balance to be returned to you.

Once you have submitted your request you will receive a confirmation message that the transfer has been completed and your balance will then clear to zero. In order to place any further bets you will be required to transfer a minimum deposit of �£5 or equivalent into your account.

Your transferred funds will leave us at the close of business each day and will be processed as follows:

Debit cards: funds will be paid back to your registered card and will be subject to the clearance period (normally three working days) of the issuing bank or building society.

Visa cards: funds will be paid back to your registered card, up to a maximum of �£2000 per day. Customers wishing to withdraw more than �£2000 in any day should contact our Customer Service team.

Mastercard cards: funds cannot be paid back to Mastercard credit cards. Withdrawals will automatically be paid to the registered bank account associated with customer accounts via an internet bank transfer, where this is possible. For additional payment methods see the Account Help Area.

For all the above methods any customer wishing to withdraw in excess of �£2000 per day is asked to contact our Customer Service team on 0800 731 4171 from 9.00am GMT Monday to 10.45pm GMT Saturday and 11.00am GMT to 5.00pm GMT on Sundays. Customers will be able to access their account statements on-line. If you have any queries regarding transactions on your account please contact our Customer Services team.


Privacy Policy

As a customer of Ladbrokes Betting and Gaming Ltd, we have a number of obligations to you with regard to the management of your personal information under the Data Protection Act 1998.
This policy sets out the way in which we will deal with the information that you provide to allow us to manage your relationship with the company.


1. INFORMATION COLLECTED

We collect personal information from customers for the purposes of:

- setting up and managing your account
- building up personal profiles and
- providing you with information about promotional offers.


2. ACCURACY

We will take all reasonable steps to ensure that any information that we hold about you is accurate and current.

3. MONITORING OF TRANSACTIONS

All of your bets and account transactions are recorded on our computer systems. We also carry out routine monitoring of all transactions as they take place to assist us in improving the service that we provide to you.


4. TELEPHONE BETS

Your telephone conversations with our call centre agents may be recorded to assist in the training of our agents, and in the resolution of any queries arising from the service you receive.


5. INTERNET BETS

Transactions carried out on our Internet websites automatically collect information using cookies. A "cookie" is a small piece of information sent by a web server to a web browser, which enables the server to collect information from the browser. Find out more about the use of cookies on
www.cookiecentral.com. We use cookies to keep track of your browsing patterns and to build up a demographic profile.


6. SECURITY AND PRIVACY

We will take all reasonable steps to ensure that your information is kept securely and protected from unauthorised access.

We will only disclose personal information to associated or subsidiary companies, and to business partners, successors in title to our business and suppliers that are engaged to process such information on our behalf.


7. RETENTION AND DISPOSAL

We are required by Law to retain and make available financial information for a period of 7 years. Other personal information will be retained only while it has relevance to your account with us, or to our obligations to you. All information not required for legal purposes will be destroyed within 5 years of an account being closed.

We will take all reasonable steps to ensure that the privacy of personal information is maintained on disposal. To this end, all hardcopy (paper etc) documentation is shredded, and all information held on computer media is erased when they are no longer required.


8. INTERNET-BASED TRANSFERS

Given that the Internet is a global environment, using the Internet to collect and process personal data necessarily involves the transmission of data on an international basis. Some of the data processors engaged to process personal data may be based outside of the European Economic Area. Therefore, by browsing our web site and communicating electronically with us, you acknowledge and agree to our processing of your personal data in this way.


9. CUSTOMER SECURITY

We are committed to providing customers with a secure environment in which to place their bets. Therefore, as part of our security procedures we do, from time to time, screen the data supplied to us by our customers. The purpose of the screening is to protect both our customers and us against identity fraud and is carried out in strict accordance with Data Protection Act guidelines.
